1. Agreement to Terms

These Terms of Service ("Terms") form a binding agreement between you and Tally Finance ("Tally Finance," "we," "our," or "us") and govern your access to and use of the Tally Finance website at tallyfi.appand all related applications, features, and services (collectively, the "Service").

By creating an account, accessing, or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old and capable of forming a binding contract to use the Service. By using Tally Finance, you represent and warrant that you meet these requirements and that the information you provide is accurate and complete.

3. Description of the Service

Tally Finance is a personal finance management tool that helps you connect financial accounts, track transactions, build budgets, monitor net worth, detect subscriptions, and view analytics and AI-generated insights. Tally Finance is a software tool only. It is not a bank, credit union, lender, money-services business, broker-dealer, investment adviser, or tax preparer, and it does not hold or move your funds.

4. Accounts and Security

You access Tally Finance through a third-party identity provider (such as Google or GitHub). You are responsible for maintaining the confidentiality of your login and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use. We are not liable for losses arising from your failure to safeguard your credentials.

5. Subscriptions, Billing, and Cancellation

  • Free Trial: New accounts include a 30-day free trial. No payment method is required to begin the trial.
  • Paid Subscription: After the trial, continued use requires a paid subscription billed at the then-current rate (e.g., $7.99/month or $79/year). Prices are shown at checkout and may change with notice.
  • Billing: Payments are processed by Stripe. By subscribing, you authorize recurring charges to your payment method until you cancel.
  • Cancellation: You may cancel anytime. Access continues until the end of the current billing period; we do not provide prorated refunds for partial periods except where required by law.
  • Refunds: Except where required by applicable law, fees are non-refundable.

6. Acceptable Use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or unauthorized purpose
  • Access or attempt to access another user's account or data
  • Reverse engineer, scrape, or attempt to extract source code or data except as permitted by law
  • Interfere with, disrupt, or overload the Service or its infrastructure
  • Upload malicious code or attempt to breach security or authentication measures
  • Resell, sublicense, or commercially exploit the Service without our written permission

7. Third-Party Services

The Service integrates with third-party providers including Plaid (bank connectivity), Stripe (payments), and others. Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the acts, omissions, availability, or accuracy of third-party services. Account data retrieved via Plaid may be delayed, incomplete, or inaccurate.

8. No Financial, Investment, Tax, or Legal Advice

All content, insights, summaries, projections, valuations, and figures provided by the Service — including AI-generated output and any home, vehicle, or investment value estimates — are for informational and educational purposes only. They do not constitute financial, investment, tax, accounting, or legal advice, and must not be relied upon as such. Past performance is not indicative of future results. You are solely responsible for your financial decisions and should consult a qualified, licensed professional before acting. Tally Finance is not a fiduciary.

9. AI-Generated Content

Certain features use automated and AI systems to generate insights and summaries. This output may be inaccurate, incomplete, or misleading and is provided "as is." You should independently verify any information before relying on it.

10. Intellectual Property

The Service, including its software, design, text, and branding, is owned by Tally Finance and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal use in accordance with these Terms. Your financial data remains yours; you grant us a limited license to process it solely to provide the Service.

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DATA WILL BE ACCURATE OR COMPLETE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TALLYFI AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (B) USD $100.

13. Indemnification

You agree to indemnify and hold harmless Tally Finance and its affiliates from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or to protect the Service or other users. Upon termination, your right to use the Service ceases; data retention and deletion are governed by our Privacy Policy.

15. Changes to the Service and Terms

We may modify or discontinue features at any time. We may update these Terms from time to time; if we make material changes, we will provide notice by email or within the Service. Your continued use after changes take effect constitutes acceptance of the revised Terms.

16. Governing Law and Dispute Resolution

These Terms are governed by the laws of the United States and the state in which Tally Finance's operating entity is established, without regard to conflict-of-laws principles. Any dispute not resolved informally will be settled by binding arbitration on an individual basis; you and Tally Finance waive the right to a jury trial and to participate in a class action, except where prohibited by law.
